These Terms of Use govern your access to and use of LMSCursio (the “Service”). They are intended for use within the EU/EEA and should be read together with our Privacy Policy. Items shown in brackets must be completed by the operating institution, and these terms should be reviewed by qualified legal counsel before launch. Nothing here limits any mandatory rights you have under EU or national consumer-protection law.
1. Acceptance of these terms
By accessing or using the Service you agree to these Terms of Use. If you are using the Service on behalf of an institution, you confirm you are authorised to accept these terms for that institution. If you do not agree, please do not use the Service.
2. The service
LMSCursio is a learning management platform that lets institutions deliver courses, assignments, quizzes, grading, communication and related teaching tools. The Service is provided to institutions and to their authorised users (such as instructors, students and administrators).
3. Accounts and eligibility
- Accounts are normally created and managed by your institution. You are responsible for keeping your credentials confidential and for activity under your account.
- You must provide accurate information and keep it up to date.
- Notify your institution or us promptly of any unauthorised use of your account.
- Where the Service is used by minors, it is made available through and under the responsibility of the institution.
4. Acceptable use
You agree not to:
- break the law or infringe the rights of others;
- upload malware, attempt to gain unauthorised access, or disrupt the Service’s security or integrity;
- post unlawful, harassing, hateful or infringing content;
- scrape, copy or reuse other users’ personal data except as your role legitimately requires;
- misrepresent your identity or impersonate others.
5. Your content
You retain ownership of the content you submit (such as assignments, posts and files). You grant us and your institution a limited licence to host, store, display and process that content solely to operate and provide the Service. You are responsible for ensuring you have the rights to the content you upload.
6. Academic integrity
Where the Service supports assessment, you agree to follow your institution’s academic-integrity rules. The Service may provide originality and exam-integrity tools; their use is configured by the institution, and outcomes are reviewed by staff, not decided solely by automated means.
7. Intellectual property
The Service, including its software, design and trademarks, is owned by us or our licensors and is protected by intellectual-property law. Except for the rights expressly granted to use the Service, no rights are transferred to you. Course materials provided by your institution remain the property of the institution or its licensors.
8. Privacy and data protection
We process personal data in accordance with the GDPR and our Privacy Policy. Where your institution is the data controller, the institution’s own privacy information also applies, and we act as a processor on its documented instructions under Article 28 GDPR.
9. Availability and changes
We work to keep the Service available and reliable, but we do not guarantee uninterrupted access and may carry out maintenance. We may add, change or remove features over time. We may update these terms; where changes are material, we will provide reasonable notice through the Service. Continued use after changes take effect means you accept the updated terms.
10. Disclaimers and liability
The Service is provided with reasonable skill and care. To the extent permitted by law, we exclude implied warranties not expressly stated here. Nothing in these terms excludes or limits liability that cannot be excluded under EU or national law — including liability for death or personal injury caused by negligence, for fraud, or any mandatory consumer rights. Subject to that, we are not liable for indirect or unforeseeable loss, and our total liability is limited as set out in the agreement between us and your institution.
11. Suspension and termination
Your institution may suspend or close your account in line with its policies. We may suspend or restrict access where necessary to protect the Service, other users or to comply with the law. On termination, your right to use the Service ends; data is handled as described in the Privacy Policy and the institution’s instructions.
12. Governing law and disputes
These terms are governed by the laws of [EU Member State / country], without affecting any mandatory protections of the law of the country where you live.
